Our mental health team are experienced in representing defendants suffering from mental disorder in criminal proceedings, appealing against convictions on the basis of misdiagnosis, as well as defences of insanity or diminished responsibility.
We will also advise and act for patients who have been detained in hospital for assessment or treatment under the Mental Health Act, or under hospital orders including matters involving detention at Ashworth and other secure hospitals. We represent both at First Tier Tribunals and the Upper Tribunal, as well as considering other options for action or redress.
Members of the team are also regularly instructed to represent the interests of mental health hospitals that provide conditions of high, medium and low security for patients.
We also handle cases involving mental capacity issues, including Court of Protection applications.
